Spain: Orangina-Schweppes settles CNMC parallel trade investigation

The Spanish National Competition and Markets Commission (CNMC) has closed an investigation of Schweppes, S.A., the Spanish subsidiary of the Orangina Schweppes Holding B.V. group (“OSHBV”) in relation to restrictions of parallel trade. The CNMC opened an investigation in September 2015 after receiving a complaint against agreements between Schweppes S.A. and several distributors including a clause preventing the distributors from selling Schweppes branded tonic water that had not been produced in Spain. El TC declara inconstitucional el sistema de licencia única

El Tribunal Constitucional declara la inconstitucionalidad del principio de eficacia en todo el territorio nacional, también conocido como sistema de licencia única, establecido en los artículos 19 y 20 de la Ley 20/2013, de 9 de diciembre, de garantía de la unidad de mercado (“LGUM”) por vulnerar el principio constitucional de territorialidad de las competencias, en el que se fundamenta el Estado autonómico.
